▍背景
今年三月，学期伊始，老师讲课愈发跳脱于书本之外，于是我心血来潮，想尝试「无纸化学习」，遂在淘宝网店「电讯手机数码」购买 iPad 2020 128G 平板电脑一部，花去 2810 大洋，从此便踏上一段时长两月的维权之旅。

购买前，商家向我保证：此乃全新机，顺丰朝发夕至。电脑到手，于官网查询序列号，确实未激活。
到这并没有结束，本人第一次使用苹果产品，生怕翻车，于是我留了个心眼，去公众号「果粉鉴定服务号」再次查询。
好家伙，不查不知道，一查吓一跳，设备容量上赫然写着：32GB。数字对不上，我立马打电话给 Apple 客服，再次查询此序列号，仍然是 32GB。

这下我的心直接凉了半截，血翻涌上头，世界崩塌，一下子不知所措，心想：完了，这次是真翻车——买到扩容机了。我真没想到苹果产品水这么深啊！刚开始推行无纸化学习「未半而中道崩殂」，难道真的是「无纸不行」？
回过神，与卖家对质，亮出证据，卖家直接装傻充愣，然后便是已读未回。在我提出维权之后，商家直接回了句：「不想要可以退」，一副理所当然的样子。
我一下子就火了：真把我当傻子了？我张某人，素来最痛恨欺骗和背叛。如今有人欺负到我头上，不但回避问题，还倒打一耙——是因为我不想要、我太「挑剔」，才导致这样的结果，你这不是欺负老实人吗？
是可忍孰不可忍。
于是我便在此刻下定决心：要走法律途径维权，与卖家死磕到底，扇扇对面那恬不知耻的狗脸。
我在知乎上发现了一大批遇到类似情况的知友，包括但不限于买到扩容机、二手翻新机、盗版机等情形。
我虽非法律科班出身，但我善于学习、明于辩理。而且我有两位非常要好的职业法师朋友：李泽毅和陈荣耀，前已提及。两位好友在我迷茫时提供了许多专业的建议，再次感谢他们的大力相助。
本着吐气扬眉和交流学习的目的，遂有此文。希望大家以后在遇到这种情况的时候，不要害怕和忧虑，抄起法律武器，保护自己的合法权益。
以下是我的维权经过，供各位参考：
2021 年 3 月 23 日，在淘宝店「电讯手机数码」购买 iPad 2020 128G 平板电脑一部，2810元。
在这里提一嘴，虽然买到扩容机当然是我贪便宜的锅，但这个购买价格仍处于合理区间。iPad 2020 128G，官网售价 2999 元，教育优惠 2849 元，拼多多百亿补贴曾一度优惠到 2749 元。我以为卖家是从拼多多倒卖到淘宝赚取差价，且该店铺成立时间久、销量大，并以文字形式给我承诺，我才敢买。
卖家承诺
3 月 24 日，收到 iPad，在微信公众号「果粉鉴定服务号」查询并向苹果官方客服求证（有录音），发现是扩容机。
店家卖给我的扩容机确实是全新未激活的，他没有骗我。但是容量是改装的。iPad 里显示是128G，一切正常。苹果官网只能查到未激活，查不到容量。这些无良商家就是利用了这个漏洞，赌你不会查序列号初始容量，骗你的钱。
容量查询一切正常
还有两个小细节：
一是屏幕有轻微划痕，在贴膜时发现，起初以为是瑕疵，没想到是伏笔；
二是盒子背面是假的，油印痕迹很重，没有「Energy Star」的标志。
当日中午，与卖家协商无果，决定走法律途径。立刻在可靠渠道再买一台 iPad 急用，准备持久作战。
▍确定管辖法院
向法院提起民事诉讼，首先要确定管辖法院，管辖分为地域管辖与级别管辖。
这起网络购物合同纠纷中，合同已实际履行，根据《中华人民共和国民事诉讼法》第二十三条、《最高人民法院关于适用<中华人民共和国民事诉讼法>的解释》第二十条：
第二十三条 因合同纠纷提起的诉讼，由被告住所地或者合同履行地人民法院管辖。 第二十条 以信息网络方式订立的买卖合同，通过信息网络交付标的的，以买受人住所地为合同履行地；通过其他方式交付标的的，收货地为合同履行地。合同对履行地有约定的，从其约定。
我作为买受人，则我的住所地广州市法院对本案具有管辖权。原则上，一审民事案件均由基层法院管辖，故广州市天河区基层人民法院对本案具有管辖权。
不同的是，在广州有一个消费者的维权利器——广州市互联网法院，意味着我足不出户就可以起诉卖家，我甚至不需要到法院，就可以实现起诉、调解、立案、送达、调解、庭审、宣判、执行等全部或部分诉讼环节的网络化办理。
根据《最高人民法院关于互联网法院审理案件若干问题的规定》第二条：
北京、广州、杭州互联网法院集中管辖所在市的辖区内应当由基层人民法院受理的下列第一审案件： （一）通过电子商务平台签订或者履行网络购物合同而产生的纠纷； …… （十一）上级人民法院指定管辖的其他互联网民事、行政案件。
最终，我的起诉法院是广州互联网法院。
▍取得卖家信息
提起诉讼，必须要有被告的身份信息（身份证号、住址、联系电话等），获取信息需要向淘宝客服提出申请，他会给你提供链接，照做就行。收货当日晚，我向淘宝官方递交商家信息披露申请书，申请获得卖家个人信息。

4 月 7 号，终于收到淘宝披露的卖家信息。期间搞了个大乌龙，披露了另一家的信息。正常来说，应该是五个工作日内完成。
终于等到了
淘宝的客服非常垃圾，外包的，没有实权，无法做到披露卖家信息这种涉及隐私的事情。只会让你等待，不断逐级向上转接，转接到最高层也无法解决我的问题，纯粹浪费时间。
打客服热线也没用，每次开头淘宝小蜜那声音听得我想吐，「亲，我在……」，然后自顾自说一大堆，还不能跳过。你跟它说稍微复杂的问题它又听不懂，你说要找人工它就会说「小蜜也可以帮您」，然后又跟你扯皮半天。都 2021 年了，还有纯粹的人工智障，直接治好了我多年的低血压。
某位张姓哲人曾说过，这种外包客服的本质是为了增加你的维权成本，让你望而生畏。当你成本高了，自然就不想去维权，淘宝的售后成本自然就低了。
但是我有一股韧劲儿、一种锲而不舍的精神（其实是闲的），疯狂给客服打电话（大概几十个），最后惊动了淘宝的维权部门，给我安排专人跟进。
▍取得官方检测单
3 月 25 日，我去广州天环广场 Apple Genius Bar 找到工程师再次确认，并得到官方检测单一份。这是本次维权的关键证据。Genius Bar 要提前预约，人比较多，注意准时。

与此同时，我还多线操作，向淘宝、12315 投诉并提出正当诉求。中山大法师李泽毅告诉我，提起诉讼前应当穷尽所有非诉手段，虽然法院并不会追究此事，但是程序应当完备。同时，这种细节写到起诉书里会显得自己很牛逼。淘宝、12315 都不是审判机关，不具有审判权和执行权，无法满足我退一赔三的正当诉求。这我当然知道，所以我也是走走形式。
如何于 12315 投诉，可以参考：「汉堡王被曝销售过期食品，遇到这种情况你该如何维权？」这篇文章中的第一部分。
▍提起诉讼
4 月 7 日晚，取得了被告身份信息，撰写好起诉书，我便向广州市互联网法院起诉。主要法律依据是《中华人民共和国消费者权益保护法》第 55 条：
经营者提供商品或者服务有欺诈行为的，应当按照消费者的要求增加赔偿其受到的损失，增加赔偿的金额为消费者购买商品的价款或者接受服务的费用的三倍；增加赔偿的金额不足五百元的，为五百元。法律另有规定的，依照其规定。 经营者明知商品或者服务存在缺陷，仍然向消费者提供，造成消费者或者其他受害人死亡或者健康严重损害的，受害人有权要求经营者依照本法第四十九条、第五十一条等法律规定赔偿损失，并有权要求所受损失二倍以下的惩罚性赔偿。
我的主要诉求是：退一赔三（包括购物款 2810 元，赔偿款 8430 元，共 11240 元）。起诉状是我自己写的，参考了裁判文书网上的同类案件，中政法法师陈荣耀看了都说专业。

▍提供补充材料
4 月 9 日晚，预立案补证。他会给你一个清单，让你补充材料。这里不得不夸夸广州互联网法院的便捷和人性化：诉讼平台与电商平台数据是相通的。我输入了淘宝的交易单号，他就直接调取了买卖方个人信息、交易物流和交易快照等信息，可谓是一站式诉讼体验，这波完全被互联网法院拿下！

▍调解
4 月 21 日，经过漫长等待，法院通知调解。介于卖家此前态度，我直接打电话给调解员拒绝调解，加快诉讼进程。
▍立案
4 月 26 日，法院通知立案，送达文书。本案依法适用小额诉讼程序审理。
4 月 27 日，缴纳诉讼费 41 元。
4 月 28 日，收到法院传票，告知开庭时间：6 月 2 日上午 9:30。

接下来就是漫长的等待。天气逐渐变热，生活也在继续：学车、上课、做实验……其间，淘宝店店主找我协商三次，非常精彩。
▍卖家多次来电沟通
5 月 11 日，卖家第一次来电。一上来就张嘴说电脑没有问题，是官换机，甩锅给官方。并且劝我不要打官司，问我有这么多时间吗？万一打输了怎么办？啰里啰唆一大堆，听起来完全没有搞清楚状况。我尖锐地打断他，说我很有时间准备死磕，并且胜券在握（他这种法盲能赢就有鬼了），同时大声质问他是否查看起诉状并了解我的诉求。他说没有，我直接挂断了电话。舍友全程听着，说我很牛逼。
5 月 13 日，卖家第二次来电。这次态度转变，承认「好像确实是我们的问题」（谢天谢地你终于发现了），是供应商的问题（经典甩锅），表示愿意赔偿我的损失（不好意思，你不愿意也得赔）。时隔近两个月才联系我，是因为一直在忙家里的事（你忙，关我什么事？难道你要用你的错误来惩罚我？）。现在收到了传票，想和解（翻译过来就是事情闹大了，发现我是硬茬儿，想赔钱了事）。
可是我哪有这么好忽悠啊？在店铺的另一条链接的提问区和评论区，有非常多的人反映商品是扩容机（我之前没看到这个链接，百密一疏），说明我绝非个例。如果只有我一家到扩容机，确实有可能是供应商不厚道。现在一大堆人跳出来说有问题，说明店家是专门卖扩容机、靠坑蒙拐骗赚黑心钱的。发现并曝光问题的买家尚且有这么多，那那些没发现的呢？我都不敢想了。
况且，在 3 月底的时候，我就跟卖家发出严正警告，又通过各种渠道投诉卖家，卖家无动于衷。四月初，我在评论区直接公开举报：此乃扩容机，把起诉书贴了上去，结果卖家直接把产品下架了，新建一个链接卖！呵呵，现在倒好，收到传票了，良心发现了？
当初只要你好好承认错误，道歉赔款意思一下，我也不至于搞这么大阵仗。现在都五月中旬了，还有十几天就开庭了，生米都煮成熟饭了，还指望我原谅你？早干嘛去了？不是不给你机会，是给你你不中用啊！

我直接表示，退一赔三，一分钱都不能少。
5 月 15 日，第三次来电。他表示只能接受退一赔一。谈崩了，不能提早拿到赔偿，只能走法律途径。
为了确保胜诉，我补充了证据，还咨询了西南政法大学的研究生姐姐。她告诉我，这种欺诈情节清晰的案件，基本不存在变数，谁来都要遵守法律流程、不能颠倒黑白。况且，这种标的才一万多的案子，根本就没有律师会接。我想，本案唯一的变数就是开庭时的校园网了吧。
▍正式开庭
6 月 2 日，开庭。心情紧张又激动，就好像毕业论文答辩一样。即使画面这么糊，我也能看出法官姐姐很可爱漂亮，很像我的一个师妹。她开头跟我寒暄了几句，声音很温柔。一开庭，立马用正经的播音腔宣读法庭纪律，判若两人。
庭审全程直播公开，所以截图没毛病。法官很有气质。
期间她还问我读哪个大学，大几了，是不是第一次诉讼，是不是专门学法的。可恶，又让我装到了！
她对我的关键证据——Apple Genius Bar 提供的检测单提出了疑问，如何证明这是苹果官方开具的？如何证明这是在广州天环广场开具的？能否验证这份报告的真实性？说实话这一连串问题，就好似老师提问，直接把我问懵了。我的思维不够严密，没有想到去证明这些看起来理所当然的东西。好在我一一化解了。
不难看出，法官对案件毫无准备，证据都没看过，还向我问东问西。舍友评论说，他申报书答辩的评委老师也是这样。不过话说回来，这种案件也不需要提前准备，我奶奶都闭着眼睛都能审。
被告未出席，可以缺席判决。大概过了半个小时，法官告知休庭，择日宣判。法官一般是不会预设立场当庭宣判的，择日宣判是常态。
▍判决
6 月 11 日，判决书送达，支持我的诉求，为终审判决，结案，该审判书以后应该能在裁判文书网上搜到。至此两个月的维权告一段落，现在就等卖家七日内给我打钱，否则我就申请强制执行。强制执行就意味着成了「老赖」，我花了 41 块钱就把对面变成了老赖，血赚不亏。

▍建议与感想
买电子产品尤其不能贪便宜。一定要通过正规渠道购买，如：天猫、京东自营、拼多多百亿补贴。这些是不可能有假的，如果有假的，那你就发财了，参考在得物上买到假鞋那件事。买到假的，如果没有像我这样的精力魄力去维权，最后只能忍气吞声。
购买时一定要索取发票，苹果售后服务是需要出示发票的。我专门问过广州天环的天才吧，没有发票无法保修。有同学反映之前 AirPods 出问题了，没带发票直接换新，这是因为产品设计缺陷，很多人都反映这个问题。上次我去检测的时候，就看到一个小哥，大老远跑过来修 AirPods Pro，结果没有发票惨遭拒绝，只能现场打电话给淘宝开发票。
消费者由于信息不对等很容易处于弱势地位，这时候我们要拿起法律的武器保护自己。随着时代发展和社会进步，我们维权成本更低，维权方式也更便捷了。我足不出户，仅耗费两个月的时间就完成了诉讼，你敢信？互联网法院真是顺应时代潮流的伟大产物，目前只有北京、杭州、广州三个地方有。其他地区也在推广微法院，大力建设网络司法。必须要让法律的铁拳砸到这些鬼魅头上，让他们知道痛，让他们无所遁形。
为什么要走法律渠道维权？这是多个因素促成的。一是我受父亲熏陶，从小就目睹他见义勇为扭送小混混去派出所、因合同违约而起诉他人，具有极强的正义感和维权意识。初中就开始运用书中所学，反抗级长、反抗老师（笑）。二是因为其他途径往往更费时费力、且效果不一定好。经过早年的维权，我对淘宝、12315 是丝毫没有信心的，所以我一开始就不奢望他们能解决问题。打给电视台多半也没有用，这种卖家，专门坑蒙拐骗卖扩容机，肯定不吃我这一套。而法院就很有用，够权威、够正式，也不会因为我标的额小就拒不受理。三是「实践出真知」，正所谓百闻不如一见，百见不如一练，丰富的法律知识需要实践来检验。李泽毅跟我说，他作为法学生，都没有完整地走完一套法律流程，没有参加过民事诉讼。我跟他说，那刚好，我走一套给你看看。
维权是一件费时费力的事情，还有可能不被他人理解。我舍友知道我要起诉之后，觉得我是自找麻烦，给自己整得不痛快。我也没敢告诉爸妈，我已经能想象到他们用「多一事不如少一事」的老生常谈来教育我的场景。到后来立案后，胜券在握了，我才告诉他们。结果我爸一听，扑哧一声，得意地笑了。
陈荣耀说，诉讼就跟辩论一样，不用去说服对方。与奸商讲道理，无异于与虎谋皮。道理讲得通的话，要法律干什么？我们要做的，就是放弃幻想，坚决走法律途径。一切反动派，都是纸老虎！
法学是一门极其讲事实、讲逻辑的学科。平时我们看起来理所当然的东西，放在法庭上可能就经不起推敲。人掌握的信息有限，眼光狭隘，极其容易受到引导，用臆想代替逻辑推断。这起诉讼完善了我的逻辑思维，同时也警示我，没事别当网络警察、网络法官，让正确的人做正确的事。
